Injunction Order and the Independent Monitor's Duties
The Independent Monitor is responsible for ensuring that the Moreno Valley Unified School District implements fair and compliant practices, especially concerning students with disabilities and Black students with disabilities. The key duties include:
Evaluating Disciplinary Practices: Assess the district's disciplinary practices, including in-school and out-of-school removals, use of restraints, and referrals to law enforcement, school resource deputies (SRDs), and campus security officers (CSOs). This evaluation will focus on identifying any adverse impacts on students with disabilities and Black students with disabilities.
Establishing Baselines and Compliance Goals: Set initial benchmarks and develop an Action Plan to guide the district’s administrative practices in aligning with the requirements of the ADA and Section 504.
Creating a Data-Driven Action Plan for Systems Change: Develop a comprehensive Action Plan with measurable, data-based outcomes to drive systems change. This plan will include revisions to district policies and procedures, specifically addressing areas of noncompliance and practices that disproportionately impact students with disabilities and Black students with disabilities.
Reducing Disproportionate Referrals and Removals: Establish a strategic Action Plan aimed at significantly reducing the number of disciplinary removals (both in-school and out-of-school suspensions) and referrals to law enforcement for students with disabilities and Black students with disabilities. This plan will also focus on increasing behavioral supports and assessments to better address disability-related behaviors and create accountability mechanisms for district staff and SRDs.
Ensuring Compliance with the Injunction Order: Oversee the district’s adherence to the terms of the Injunction Order, ensuring that all stipulated requirements are met.
